These Terms & Conditions apply to purchases made through MattressMick.ie and any related online retail sales operated by Mattress Mick Limited.

Please read these Terms carefully before placing an order. By placing an order on our website, you agree to these Terms & Conditions.

These Terms do not affect your statutory rights under Irish consumer law.

2. About Us

Mattress Mick Limited sells mattresses, beds, bedroom furniture, furniture and related products online and in-store.

These Terms apply to consumer purchases made through our website. If you are buying for business, trade, resale, commercial or non-consumer use, please contact us before ordering, as different terms may apply.


3. Products, Descriptions and Images

We take reasonable care to ensure that product descriptions, images, sizes, prices and availability details on our website are accurate.

However, product images are for illustration purposes only. Colours, finishes, fabrics, textures and shades may appear slightly different depending on your screen, lighting and device settings.

Product measurements are approximate and may vary slightly due to manufacturing tolerances, fabric, filling, packaging or supplier changes.

Goods sold to consumers must comply with Irish consumer law, including being as described, of satisfactory quality, fit for their normal purpose, safe and durable.


4. Prices, VAT and Delivery Charges

All prices on our website are displayed in Euro (€).

Unless stated otherwise, prices include VAT at the applicable Irish rate.

Delivery charges, mattress removal charges, furniture removal charges, assembly charges or other optional service charges will be shown separately before you complete your order, where applicable.

We may change prices, promotions, offers and delivery charges at any time. Any changes will not affect orders that we have already accepted.

If a pricing error appears on our website, we may cancel the order and refund you in full. If this happens, we will contact you as soon as reasonably possible.


5. Placing an Order

To place an order, you will normally need to:

  1. Choose the product or products you wish to buy.

  2. Add them to your basket.

  3. Enter your billing, delivery and contact details.

  4. Review your order, including product details, delivery address, delivery charge and total price.

  5. Correct any errors before submitting the order.

  6. Confirm that you have read and agree to these Terms & Conditions.

  7. Submit payment or choose an available payment method.

You are responsible for checking that your order details are correct before completing your purchase, especially the product, size, colour, delivery address, phone number and email address.

If you notice an error after placing your order, please contact us as soon as possible at care@micks.ie or 01 677 2485. We will try to help, but we cannot guarantee changes once an order has been processed, dispatched, ordered from a supplier, customised or delivered.


6. Order Acceptance and Contract Formation

After you place an order, you may receive an automatic email acknowledging that we have received your order. This does not mean your order has been accepted.

A contract between you and Mattress Mick Limited is formed only when we issue an order confirmation, dispatch confirmation, delivery confirmation, or otherwise confirm acceptance of your order.

We may refuse or cancel an order where, for example:

  • the product is unavailable;

  • the product has been discontinued;

  • there has been a pricing or description error;

  • payment has not been authorised;

  • delivery cannot reasonably be completed to the address provided;

  • incorrect information has been provided;

  • we suspect fraud, misuse or unauthorised activity;

  • the order is unsuitable for online processing.

If we cancel an order after payment has been taken, we will refund you using the original payment method.


7. Payment

Payment must be made using one of the payment methods available at checkout.

We may offer card payments, online payments, finance options, buy-now-pay-later options, deposits, cash on delivery or other payment methods from time to time. Available payment options may vary.

Where you use a third-party payment provider, finance provider or buy-now-pay-later provider, your use of that service may be subject to that provider’s own terms and conditions.

Goods may not be delivered until payment has been received or approved, unless we have agreed otherwise in writing.


8. Availability and Supplier Delays

Some products may be in stock and available for fast delivery. Other products may need to be ordered from a supplier or manufacturer.

Delivery dates and lead times shown on the website or given by our staff are estimates unless we have expressly confirmed a guaranteed delivery date in writing.

If a product is delayed, discontinued or unavailable, we will contact you as soon as reasonably possible. We may offer you a revised delivery date, an alternative product, or a refund.


9. Delivery

We deliver to addresses in Ireland, subject to product availability, delivery coverage and access.

Delivery options and charges will be shown before you complete your order, where applicable.

Typical delivery times depend on product availability, supplier lead times, delivery location, seasonal demand and access requirements. Dublin deliveries may sometimes be available faster where items are in stock, but this is not guaranteed unless confirmed by us.

You must ensure that:

  • the delivery address is accurate and complete;

  • someone is available to accept delivery at the agreed time;

  • we have a correct phone number for delivery contact;

  • there is safe and reasonable access for our delivery team;

  • doors, staircases, hallways, lifts and rooms are large enough for the goods;

  • the route into the property is clear of obstacles, fragile items and hazards;

  • parking, loading or access arrangements are available where required.

If delivery cannot be completed because of incorrect details, restricted access, nobody being available, unsafe conditions, parking restrictions, or the goods not fitting into the property, we may charge a failed delivery, redelivery, storage or cancellation fee.


10. Doorstep Delivery, Room-of-Choice Delivery and Assembly

Unless otherwise agreed, delivery may be to the doorstep, hallway, ground-floor entrance or another safe access point.

Where room-of-choice delivery is offered and agreed, our delivery team will use reasonable care when bringing goods into your home. However, you are responsible for ensuring that access is suitable.

We are not responsible for damage caused by unsuitable access, tight staircases, narrow doors, low ceilings, fragile fittings, weak floors, pre-existing defects, or where you ask us to attempt delivery despite our reasonable concerns.

If assembly is offered, it may be provided by us or by a third-party assembler. If a third-party assembler is paid directly by you, that assembly service may form a separate contract between you and the assembler.

Nothing in this section limits our liability where damage is caused by our negligence, nor does it affect your statutory rights.


11. Mattress Removal and Furniture Removal

We may offer mattress removal, bed removal or furniture removal as an optional service.

Removal services must be booked in advance and may be subject to an additional charge. The charge will be shown or confirmed before the service is provided.

Items for removal must be safe, accessible and ready for collection. We may refuse to remove items that are wet, heavily soiled, contaminated, unsafe, infested, excessively heavy, dismantled unsafely, or otherwise unsuitable for removal.

Removal services may not be available in all areas or for all items.


12. Risk and Ownership

Risk in the goods passes to you when the goods are delivered to you or to a person nominated by you.

Ownership of the goods passes to you when we have received full payment for the goods and any related delivery or service charges.


13. Your Right to Cancel Online Orders

If you are a consumer and you buy goods online, by phone or by another distance-selling method, you generally have the right to cancel the contract within 14 days without giving any reason.

The cancellation period usually expires 14 days after the day you, or a person nominated by you, receives the goods.

If your order is delivered in multiple parts, the cancellation period usually expires 14 days after you receive the last item.

To cancel, you must clearly tell us that you wish to cancel. You can contact us by email, phone or post.

14. Returning Goods After Cancellation

If you cancel under the 14-day cooling-off right, you must return the goods to us no later than 14 days after telling us that you wish to cancel.

Unless we agree otherwise, you are responsible for the direct cost of returning the goods.

Because mattresses, beds and furniture are bulky items, they may not be suitable for normal postal return. If you ask us to collect the goods, we may charge a collection fee. The amount will depend on the item, location and collection requirements and will be confirmed before collection.

Goods should be returned in a clean, complete and reasonable condition, with all parts, accessories, manuals and packaging where possible.

You may inspect the goods in the same way you would reasonably inspect them in a shop. However, you are responsible for any reduction in value caused by handling the goods more than necessary to establish their nature, characteristics and functioning.

We may reduce your refund if the goods have been used, damaged, marked, soiled, assembled in a way that causes damage, or handled beyond what is reasonably necessary.


15. Exceptions to the Right to Cancel

The 14-day cooling-off right does not apply in certain cases, including:

  • goods made to your specifications;

  • bespoke, custom-made or personalised products;

  • custom-size beds, mattresses or furniture;

  • sealed goods that are not suitable for return for health protection or hygiene reasons, where they have been unsealed after delivery;

  • services that have been fully performed with your prior agreement and acknowledgement that cancellation rights may be affected once the service is completed.

This may include, for example, custom-size beds, custom furniture, special-order items made specifically for you, or hygiene-sensitive bedding products where sealed packaging has been opened.

These exceptions do not affect your rights if the goods are faulty, damaged, not as described or otherwise do not comply with Irish consumer law.


16. Refunds After Cancellation

If you cancel your order under your cooling-off right, we will refund the price paid for the goods and the standard delivery charge, where applicable.

We are not required to refund extra charges for enhanced delivery services, premium delivery options, assembly, removal or other optional services that you specifically selected, except where required by law.

We will issue the refund without undue delay and no later than 14 days after the earlier of:

  • the day we receive the returned goods; or

  • the day you provide evidence that you have returned the goods.

Refunds will be made using the original payment method unless we agree otherwise.


17. Faulty, Damaged or Incorrect Goods

Your rights in relation to faulty, damaged or incorrect goods are separate from your 14-day cooling-off right.

If goods are faulty, damaged, not as described, missing parts, or incorrect, please contact us as soon as possible with your order number, a description of the issue and photographs where helpful.

We ask that visible delivery damage is reported within 48 hours of delivery where possible. This helps us investigate quickly with the delivery team or supplier. However, this does not remove or reduce your statutory rights.

Where goods do not comply with Irish consumer law, you may be entitled to a repair, replacement, refund, price reduction or other remedy depending on the circumstances.

If a fault appears within 30 days of delivery, you may have the right to reject the goods and receive a refund, provided the legal conditions are met.

We may ask to inspect the goods before deciding the appropriate remedy. Please do not dispose of goods, packaging or parts before we have had a reasonable opportunity to inspect or resolve the issue.

Faults caused by misuse, accidental damage, normal wear and tear, incorrect assembly by you or a third party, failure to follow care instructions, unsuitable storage, damp conditions, infestation, commercial use, or use with an unsuitable base or frame may not be covered.


18. Guarantees and Manufacturer Warranties

Some products may come with a manufacturer’s guarantee or warranty. The terms, length and coverage of any manufacturer warranty will depend on the manufacturer.

A manufacturer warranty is in addition to your statutory rights and does not replace them.

You may be asked to provide proof of purchase, photographs, product labels, batch numbers or other information when making a warranty claim.


19. Product Care and Use

You are responsible for using products safely and in accordance with any care instructions supplied.

For mattresses and beds, this may include:

  • using a suitable bed frame or base;

  • rotating the mattress where recommended;

  • not bending or folding the mattress unless it is designed for that purpose;

  • keeping the product clean and dry;

  • using the product for normal domestic purposes only;

  • following manufacturer care instructions.

Failure to follow care instructions may affect warranty coverage and may affect whether a product is considered faulty.


20. Sale Items, Clearance Items and Outlet Products

Sale, clearance and outlet products are still covered by your statutory rights.

Where a product is sold with a clearly stated fault, mark, imperfection or condition issue, you cannot later claim that specific disclosed issue as a fault.

This does not affect your rights if the product has another fault, is unsafe, is not as described, or does not comply with Irish consumer law.


21. Website Content and Intellectual Property

All content on this website, including text, images, logos, product descriptions, graphics, layout, design, photographs, videos and branding, is owned by or licensed to Mattress Mick Limited unless otherwise stated.

You may use the website for personal shopping purposes only.

You may not copy, reproduce, scrape, republish, modify, distribute or commercially exploit our website content without our written permission.

The “Mattress Mick”, “Mattress Mick’s” and related names, branding, logos and marks are protected and may not be used without permission.


22. Reviews, Promotions and Discount Codes

From time to time, we may offer discounts, promotions, coupon codes or special offers.

Promotions may be withdrawn or changed at any time. They may be subject to separate terms, expiry dates, product exclusions or stock limitations.

Only one discount or promotion may be used per order unless we state otherwise.

Customer reviews, testimonials and product ratings must be genuine and based on real customer experiences. We reserve the right to remove reviews that are abusive, false, misleading, unlawful, spam, or unrelated to the product or service.


23. Privacy and Data Protection

We process personal data in accordance with our separate Privacy Policy.

Our Privacy Policy explains what personal data we collect, why we collect it, how long we keep it, and who we share it with.

This may include sharing necessary information with payment providers, delivery companies, IT providers, customer service tools, email providers, CRM systems, analytics providers and other service providers.

If we use tools such as Crisp, SalesBrain, email marketing platforms, advertising pixels, analytics tools or similar services, these should be explained in our Privacy Policy and Cookie Notice.

Non-essential cookies, including marketing and tracking cookies, should only be used where valid consent has been obtained.


24. Limitation of Liability

Nothing in these Terms excludes or limits our liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • breach of your statutory consumer rights;

  • any other liability that cannot legally be excluded or limited.

To the fullest extent permitted by law, we are not liable for indirect, consequential or commercial losses, including loss of profit, loss of business, loss of revenue, loss of goodwill, loss of opportunity or business interruption.

Where you purchase goods as a consumer, these limitations do not affect your statutory rights.


25. Events Outside Our Control

We are not responsible for delay or failure to perform our obligations where this is caused by events outside our reasonable control.

This may include supplier delays, transport disruption, extreme weather, fire, flood, strikes, accidents, illness, technical failures, power cuts, cyber incidents, changes in law, or other events beyond our control.

If such an event affects your order, we will contact you as soon as reasonably possible.

We may update these Terms & Conditions from time to time.

The Terms that apply to your order are the Terms in force at the time you place your order, unless a change is required by law.

The latest version of these Terms will be available on our website.


28. Governing Law and Jurisdiction

These Terms and any contract between you and Mattress Mick Limited are governed by the laws of Ireland.

If you are a consumer resident in Ireland, disputes will be subject to the jurisdiction of the Irish courts.

Nothing in these Terms affects any mandatory consumer protection rights that apply in the country where you live.
